Welcome to My Schedule App. These Terms of Service ("Terms") govern your access to and use of our workforce management and employee scheduling platform. By accessing or using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using My Schedule App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and your agreement to these Terms will be treated as the agreement of the organization.
2. Service Description
My Schedule App provides a cloud-based workforce management platform that includes employee scheduling, time tracking, attendance management, and related features (collectively, the "Service").
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to you. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
3. Account Registration and Security
To use the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information about yourself and your organization
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
4. Subscription and Billing
My Schedule App operates on a subscription-based pricing model. By subscribing to our Service, you agree to the following billing terms:
Payment Terms
Subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Payment is due at the beginning of each billing cycle. We accept major credit cards and other payment methods as indicated during checkout.
Seat-Based Billing
Plans are based on employee seat limits. Adding more employees than your plan allows requires upgrading to a higher tier plan.
Pricing Changes
We reserve the right to change our pricing at any time. For existing subscriptions, price changes will take effect at the start of your next billing cycle following reasonable notice (at least 30 days).
Cancellation
You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds will be provided for partial billing periods.
Auto-Renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
5. Refund Policy
Monthly subscriptions are non-refundable once the billing period begins. Your subscription remains active until the end of the paid period.
Exceptions
Refunds may be granted only for the following circumstances:
- Duplicate charges
- Accidental purchase reported within 24 hours, provided there was no significant usage
- Service-wide technical failure preventing legitimate use
- Fraudulent transactions validated by the payment provider
Annual Plans
Annual subscriptions may receive prorated refunds if requested within 14 days of purchase.
How to Request a Refund
To request a refund, please contact our billing team with your account email, description of the issue, invoice/receipt screenshot, and purchase date. Requests are processed within 3-5 business days.

6. Acceptable Use Policy
You agree not to use the Service for any unlawful purpose or in any way that violates these Terms. Prohibited activities include, but are not limited to:
- Violating any applicable local, state, national, or international law
- Infringing on intellectual property rights of others
- Transmitting any harmful, threatening, abusive, or harassing content
- Attempting to gain unauthorized access to the Service or related systems
- Interfering with or disrupting the Service or servers
- Using the Service to compete with us or for any commercial purpose not intended by the Service
7. Data and Privacy
We take your privacy seriously. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
You retain all rights to the data you input into the Service ("Customer Data"). By using the Service, you grant us a limited license to use, store, and process Customer Data solely for the purpose of providing the Service to you.
8. Intellectual Property Rights
The Service, including its software, features, functionality, and all related intellectual property rights, is owned by My Schedule App and is protected by copyright, trademark, and other laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes in accordance with these Terms. This license does not include any rights to resell or make commercial use of the Service or its contents.
9. Service Availability and Maintenance
We strive to maintain high availability of our Service. However, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.
We may perform scheduled maintenance that temporarily interrupts access to the Service. We will provide advance notice of scheduled maintenance when possible. Emergency maintenance may be performed without notice.
10. Limitation of Liability
To the maximum extent permitted by law, My Schedule App shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless My Schedule App and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. You may request an export of your Customer Data within 30 days of termination, after which we may delete your data in accordance with our data retention policies.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a prominent notice on our Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which My Schedule App operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
